Q&A: Copying favorite characters

😱😱😱 ohhh, I think they would have thousands of requests every day!! Never heard of it.

Everyday I see dozens of cakes using Disney characters and I am sure they did not pay for the privilege of using them. However, they are undeniably in violation of copyright laws and libel to charges, if Disney so chooses. I’ve done a few images which were subject to copyright laws, but they were donated Icing Smiles cakes and I made no profit. In the US, you cannot sell the images, but you can make them for family and friends, if you do not make a profit.

You can do a copyright image…AS LONG AS IT’S NOT FOR PROFIT!!! Believe it or not, Disney actually has a IT team that searches the internet for copyright infringements. I know two decorators personally that had letters of warning from Disney asking them to cease and desist using their images. Next time they were going to take the decorators to court. You do as a decorator do a chance using any copyright image. I have a few decorator friends who make these types of cakes, but don’t post them to their business page/social media. But will show a potential client through email. If the companies…Disney, Matel, etc., can’t see your image, then no worries.

Y, si ,son realmente estrictos, pero no van a exigirte a no ser ,que tu ofrezcas su producto directamente en tu pagina: ejemplo.- tarta mikey mousse con figura …50€ , esta forma es promocionar tu negocio sin autorización. Pero si tu cliente te pide una tarta Mikey y tu subes la foto a internet, este trabajo es tuyo, no de Disney. Ellos persiguen a quien fabrica, se promociona de forma ilícita utilizando sus marcas, personajes,….Tu vendes todo tipo de tartas, según te piden tus clientes, no puedes especificar en tu pagina, “vendo tartas de princesas Disney” esas tartas tendrian que estar autorizadas por Disney. Tu las vendes pero no las específicas, y no son creaciones Disney. Puedes poner en tu pagina:“vendo tartas de princesas”. Aunque sea de la sirenita, es una inspiración, no es la creación Disney.
